legal separation
In a marriage separation, a court determines the husband's and
wife's rights and responsibilities that emerged from marriage.
A decree of legal separation does not terminate the martial
status of the parties but is granted when the court finds that one
or both parties need a legal separation.
A legal separation can be just as complicated, if not more
complicated, than a dissolution. The parties want to separate and
determine their rights and responsibilities, but not to terminate
the marriage. A “successful” separation often depends on how
well the parties are able to allocate property, determine the
custody of children, and anything else needed to move forward with
their lives.
